A 16-year old Hamas terrorist is being treated in an Israeli hospital, captured after emerging from a terror tunnel.

The 16-year-old Hamas assailant is being treated in Ashkelon’s Barzilai Hospital and is described as being in moderate condition, Israel Radio reported on Tuesday afternoon. He was unconscious when hospitalized, the report said.

The teenager was captured after emerging from a tunnel dug from Gaza into southern Israel along with several other terrorists. In the pre-dawn attack, two groups of Hamas terrorists emerged from two tunnel exits, one inside the Israeli border near Kibbutz Nir Am, and the other near Erez, also on Israeli territory, several kilometers northeast of the Gaza city of Beit Hanoun.

The first group of infiltrators killed four Israeli soldiers. The Hamas cell, clad in IDF uniforms, emerged from the tunnel and waited for an approaching IDF jeep before opening fire, killing the IDF officer and the three other soldiers in the vehicle. Ten of the terrorists in this group were then killed by the IDF. The second group was spotted, several terrorists were killed, and no Israeli forces hurt. The radio report did not specify which terror squad the teenager had been part of.

It said a second Hamas terrorist was also in an Israeli hospital, Beersheba’s Soroka Hospital.

The report added that IDF soldiers being treated in Israeli hospitals for injuries sustained when fighting in Gaza said they encountered 13- and 14-year-old Palestinian children running at them wearing explosives-laden suicide-bomber belts.

According to the Optional Protocol to the Convention on the Rights of the Child on the involvement of children in armed conflict (adopted by the UN General Assembly), “parties to conflict” need to “take every feasible step to ensure that children below the age of 18 years do not take part in hostilities.”

Will the UN condemn the use of these children as terrorists?

It also raises a further question regarding the casualties analysis I published on here a few days ago.

I assumed many men of the 18-28 age group might be combatants.

The question now is for how many of the 11-17 age group could the same question be asked?

    I think it’s fair to consider anyone 16 and older as a “fighting aged male”; especially so when said male is actually caught engaging in hostilities. I’m not saying any random 16 year old is fair game, I just think it’s safe to assume Hamas will use anyone at that age, if needed.

      If a 5-year-old girl is pointing a gun at you, or at someone else, the rule of the pursuer likely comes into play. It is less simple if the person is non-compos-mentis. Ironically current Western practice is pretty much the reverse. (BTW, police really need better training in dealing with mentally ill people in these situations.)

    Good catch, Dave. Would like more information on this aspect of using children as combatants by Hamas. I would also like to know more about the limitations placed on Western journalists by Hamas while reporting in Gaza. Mark Regev has brought this up numerous times, but then seems to get cut off by the media outlets without being addressed by them.

      I’ve been saying this to people since day one. It’s not even immoral to allow a 16-year-old to fight, even though it may be against international conventions. (Everything Hamas does is against international conventions, and immoral.)

    I assumed from day one that there are likely to be teenage soldiers. It’s not the most uncommon thing, even in civilized countries.

    I said this in the other post. Its almost certain that many young men 14-17 are fighting too.
