hamas laughA Hamas spokesman said on Friday that Prime Minister Benjamin Netanyahu’s decision to toughen the conditions of Palestinian security prisoners in Israeli prisons constitutes a violation of international law.

Hamas spokesman Sami Abu Zuhri said that Netanyahu’s decision was an attempt to cover up his government’s failure to secure the release of captured IDF soldier Gilad Shalit.

“Israel has failed to reach the captured IDF soldier,” Abu Zuhri said. “Netanyahu is responsible for Shalit not having been returned. [Shalit] will only be returned in exchange for Palestinian prisoners.”

Abu Zahri also called on the international communityto “act against the activities of the occupation.”

On Thursday, Netanyahu announced that he plans on toughening the conditions of Palestinian security prisoners in Israeli prisons.

“I have decided to change Israel’s treatment of terrorists sitting in prison,” Netanyahu said during the closing statements at the Presidential Conference in Jerusalem. “We will give them all that they deserve according to international law but nothing beyond that.”

Netanyahu said that he is required to respect Israeli law, international law, and international trust but nothing beyond that, so Israel is taking a series of steps to change prisoners’ conditions.

“We will stop, among other things, the absurd practice in which terrorists who murdered innocent people enroll in academic studies,” he said. “There will be no more ‘doctors of terror’ – the celebration is over.”

Netanyahu’s comments come after Hamas refused Thursday to answer the International Red Cross’ request that Hamas provide proof that Shalit is still alive.

For the record, I was at Netanyahu’s speech and the cheers erupted in the hall when he announced this new policy.

As for my own views, this is a step in the right direction, but I would prefer to see convicted terrorists executed. After all, if we could execute a Nazi killer of men, women and children, what difference should it make that the murderer speaks Arabic instead of German?

  1. The fact that Israel doesn't have a death penalty is an excellent weapon against the left. That's a good reason not to execute terrorists.

    1. The problem is that it is the ONLY way to make sure they are not traded. And it may work for our few remaining friends in Europe, but the U.S. has no big problem with it.

    we do have a death penality in israel but it is complicated with various rules relating to judges who fully agree with each other and even then will not be carried out as it can be overturned.
    we do not use this form of punishment,also the full understanding does go back to biblical times,even though there has been modern translations/changes.
    it is a form of punishment that for many reasons our country has decided not to use.

        we have the laws but dont use them,and in the past death sentances have always been overturned.

    Well, first of all, it does certainly comply with Jewish values. The Torah is quite explicit, and the Talmud brings the deterrent agument in addition.

    Regarding the law, the Sanhedrin temporarliy suspended the FORMAL death penalty 2000 years ago. But this does not apply to the Noahide law. Since we need equality (see Rav Herzog), there are also non-formal death penalties. The king (such as the Knesset) and the court (I've heard it suggested tthat this is the same rule). are allowed to go beyond the law when necessary, and I think this is a good case, for those rare cases of real Jewish terrorism.
